Interim Terms
The Canadian Association for Photographic Art (CAPA) is keen to encourage the use of its website for the benefit of all, and in particular for members to share information, pictures, and knowledge in support of CAPA’s objectives and to conduct its business. CAPA recognizes that the standing and respect in which the public and other parties hold the association can be affected significantly by the conduct of its website users, both CAPA members and non-members.
Purpose of this Website Code of Use
To set out the relevant standards of behaviour expected by users of the CAPA website in order to maintain a high reputation and respected profile.
The Code of Use
Access to and use of the website of the Canadian Association for Photographic Art (CAPA) is provided by the association subject to the following general and administration conditions.
1. General: Each and every user, whether or not that user is a CAPA member, agrees that:
1.1 By the act of accessing and using the CAPA website the user shall be legally bound by these conditions. If the user does not agree the user shall not access and/or use the website.
1.2 The user has reviewed these conditions regularly to ensure they are aware of any changes made. The user’s continued use of the website after changes are posted means that they have agreed to be legally bound by these conditions as amended.
1.3 The user shall not copy or reproduce any image posted on the website without permission of the copyright owner.
1.4 The user will only post images that are their own original work. The user shall not plagiarize or infringe copyright.
1.5 The user shall access and use the website only for lawful purposes and in a way which does not infringe the rights of other users or inhibit their enjoyment.
1.6 The user shall not access and use the website in and for any prohibited behaviour, whether such prohibited behaviour is stipulated in law or by the CAPA Board of Directors. Prohibited behaviour includes unlawful or objectionable content, including posting obscene or offensive content, any form of harassment or causing distress. It also includes defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive, or otherwise objectionable material.
1.7 The user will not act at any time and conduct themselves in any manner so as to bring CAPA into disrepute. Users shall conduct themselves in a manner that does not damage or undermine the reputation of CAPA, its staff/ individually or collectively, and/or its members/ individually or collectively, and shall not take part in any activity which is in conflict with the objectives or which might damage the reputation of CAPA.
1.8 Users may not use mailing lists or data on other users for other than the purpose for which the list or data was compiled.
1.9 Except as authorized by the Board advertising is not permitted.
1.10 Users shall not use logos, crests or arms on personal or corporate notepaper or business cards for personal promotional or business purposes except where in those sections of the website where such activity is specifically approved by CPAP’s Board of Directors.
1.11 Contributions by the user shall be civil and tasteful, with courteous to all other users at all times. Users shall bring a fair and open-minded view in their website postings and discussions, respect other persons points of view, and shall ensure that all such activities are conducted with due regard to CAPA’s best interests. Contributions will be constructive and not posted with the intent of causing distress.
1.12 Users under 16 years of age shall have asked and obtained their parent’s or guardian’s approval to access to the CAPA website.
1.13 In the event of any non-compliance with the conditions CAPA has the right to take such actions as it deems appropriate and necessary.
2. Website Use Administration:
2.1 CAPA may change these conditions at any time by posting changes online.
2.2 Except as otherwise permitted by the Board a user may only login with one identity. Impersonation is not allowed.
2.3 If a user does not comply with these conditions their posts to the site may be removed and they may be denied access, in the Board’s sole discretion.
